End User License Agreement (EULA) for the works of composer Clare Pellerin

1. Grant of License

Upon purchasing and downloading your original sheet music in PDF format, you (the "Purchaser") are granted a non-exclusive, non-transferable, revocable, and personal license to use the musical score. This entitles you to store, view, and print the digital file for your own personal enjoyment, study, rehearsal, and performance.

2. Permitted Uses

The Purchaser is permitted to print multiple copies of the sheet music, provided the copies are used strictly by the Purchaser or within the immediate performance ensemble of which the Purchaser is an active, participating member or director, and for which this music is intended.

3. Restrictions and Prohibitions

The Purchaser expressly agrees not to:

  • Distribute or Share: Send, email, or transmit the PDF file to anyone who is not the original Purchaser, including posting the file on public websites, public cloud-sharing drives, or peer-to-peer networks.
  • Resell or Profit: Sell, rent, or lease the PDF file or printed copies of the sheet music for profit.
  • Create Derivative Works: Alter, edit, extract, or rearrange the underlying musical notes, lyrics, or layout to create a new, derivative arrangement for the purpose of reselling or distributing.
  • Institutional/Commercial Abuse: Provide print-outs of this sheet music to individuals who did not purchase the file or who are not part of the immediate performance ensemble of which the Purchaser is an active, participating member or director, and for which this music is intended.

4. Copyright and Intellectual Property

All copyrights, proprietary rights, and intellectual property rights in and to the sheet music remain the exclusive property of the Composer (“Clare Pellerin”). The file must contain the original copyright notice, and the Purchaser shall not remove, alter, or obscure any such notices on the digital file or printed copies.

4. Performance Rights:

This agreement covers the reproduction of sheet music only and does not include public performance rights. The Purchaser agrees to report all public performances of the work to the appropriate Performance Rights Organization (e.g., SOCAN, ASCAP, BMI, etc.) in accordance with standard venue and concert licensing regulations. Performance in non-commercial, academic recitals and concerts is permitted.

7. Video Recording & Social Media Terms

The Purchaser is allowed to record performances of this work and share them on social media platforms, and monetization of such videos is allowed, provided that all videos are credited with the song title and Composer's name (“Clare Pellerin”), and provided that the Composer retains 100% of all underlying publishing, performance, and mechanical rights. It is forbidden to create automated "synthesia" tutorials or scrolling score videos of this work. It is also forbidden to resell, redistribute, or sample the underlying musical composition for commercial use outside of a standard performance video.

8. Termination

Any failure to comply with the terms and conditions of this EULA will result in the immediate termination of this license. Upon termination, the Purchaser must destroy all digital and physical copies of the sheet music.
